1. Acceptance of these terms
Welcome to OfferBash. These Terms of Service ("Terms") govern your access to and use of the OfferBash website and any related pages, services, and communications (together, the "Site"). 5. User submissions
If you send us feedback, ideas, suggestions, or other content through a contact form, by email, or otherwise (each a "Submission"), you grant OfferBash a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute that Submission for any purpose related to operating, improving, or promoting the Site, in any media now known or later developed. You represent that you have all rights necessary to grant this license, that the Submission does not violate any third-party rights, and that the Submission is not unlawful, defamatory, or harmful. We are not obligated to keep any Submission confidential, to compensate you for it, or to respond to it.

OfferBash presents selections, opportunities, and offers from third parties. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY ERRORS WILL BE CORRECTED.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OFFERBASH OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF — OR INABILITY TO USE — THE SITE, ANY THIRD-PARTY OFFER REFERENCED ON THE SITE, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF OFFERBASH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF OFFERBASH ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PORTIONS OF THIS PARAGRAPH MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless OfferBash and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your access to or use of the Site, (b) your violation of these Terms, (c) any Submission you provide, or (d) your dealings with any third party in connection with an offer or selection presented on the Site. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.
11. Modifications to the Site
We may add to, change, or discontinue any part of the Site at any time, with or without notice. We may also restrict access to parts of, or all of, the Site without notice or liability. We are not responsible for any consequence of any change to or discontinuation of the Site.
12. Termination

13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved in the state or federal courts located in Wilmington, Delaware, and you consent to the personal jurisdiction of those courts. If applicable mandatory law in your country provides you with greater protection, those provisions will apply to the extent required by that law.
14. Changes to these Terms
We may update these Terms from time to time. When we make a material change, we will update the "Last updated" date at the top of the page and, where appropriate, take additional steps to notify you. Your continued use of the Site after such changes have been posted constitutes your acceptance of the updated Terms. 15. Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
